The W-8ECI form is a certificate you hand to a US payer to say that your US-source income is tied to a trade or business you run in the United States, so the payer doesn’t withhold the usual flat 30% at source. You don’t send it to the IRS. You give it to whoever asked for it, and you still have to file a US return on that income.
Who actually needs a W-8ECI?
Only a foreign person, and only for one kind of income. The IRS instructions say you give the form to the payer if you’re the beneficial owner of US-source income that is, or is treated as, effectively connected with a US trade or business. If you’re a Canadian freelancer paid by a US client for work done from your kitchen table in Canada, this is probably not your form. If a US company or partnership pays you for activity that counts as a US business, it might be.
That’s a big “might”. The question of effectively connected income belongs to US tax law, and the form doesn’t answer it for you. It only records your claim. We didn’t try to test that line here, and you shouldn’t guess at it either.
A good first move is to ask the payer why it sent you this form and not the W-8BEN. The payer’s onboarding team has usually decided based on what you told it about the income, so a wrong answer on the sign-up page can land you with the wrong paperwork.
What the form does and doesn’t do
Think of it as paperwork between you and the person paying you. The payer keeps it on file so it can justify not withholding. Nobody at the IRS reads it when you sign it.
| Point | What the IRS instructions say |
|---|---|
| Who receives it | The payer, the person who credits your account, or a partnership that allocates income to you |
| Sent to the IRS? | No |
| Tax identification number | Required for the form to be valid |
| How long it lasts | From the signing date to the last day of the third calendar year after it |
| If something changes | Tell the payer within 30 days and file a new form |
How long does a W-8ECI stay valid?
Longer than most people expect. Sign it in 2026 and it runs to 31 December 2029, unless something about you changes. That shelf life is the general rule in the instructions, and a payer can still ask for a fresh one sooner.
The catch is the change rule. If your name, address, status or the nature of the income shifts, you have 30 days to tell the payer. Thirty days is short. Put a reminder in your calendar the day you sign.
Do I still owe US tax if I sign it?
Yes, that’s the whole point. Claiming that income is effectively connected moves you from a flat withholding at source to filing a US income tax return and reporting it there. The IRS instructions say people who submit the form must file an annual US return for the income they claim this way. Withholding stops. The tax bill doesn’t.
So the form can look like a shortcut and turn out to be a commitment. You take on a filing obligation in another country in exchange for not being held back at source.
Here’s the cash-flow difference on a made-up payment of $10,000. Without a valid form, flat 30% withholding would take $3,000 at source and you’d receive $7,000. With a W-8ECI the payer holds nothing back, so you get the full $10,000, but you’ve promised to report it on a US return and pay whatever that return says. The $3,000 is only 30% of $10,000, our own arithmetic, and it isn’t a prediction of your actual US tax.
What to do on the Canadian side
Your Canadian return is a separate job. As a Canadian resident you report your world income to the CRA, and how a foreign tax paid is credited is set by the CRA’s own rules. We haven’t confirmed the details for this situation, so check the CRA pages on foreign income before you file. To see where this income lands in a Canadian year, try the income tax calculator on your own numbers. If the money comes through a company, the corporate tax calculator gives a Canadian-side estimate. And if you’re self-employed, the self-employed tax calculator shows income tax and CPP on that profit.
None of those tools models US tax or a foreign tax credit. They show the Canadian half only.
Common mistakes with the form
Signing it because a payer’s onboarding page listed it, without asking why, is the usual slip. The payer may have a different form in mind for your case, and the IRS keeps separate forms for other kinds of foreign payees.
Another is leaving out the tax identification number. The instructions say the form isn’t valid without it, so a blank box can mean withholding anyway.
Then there is the US return: people forget it. Nobody sends a reminder. If you can’t say who is filing it and by when, you aren’t ready to sign.
Last, a signed copy isn’t permanent. Move to a new client, restructure how you’re paid, or change your address, and the old form may no longer be right.
Who can help you decide?
A cross-border tax specialist, someone who files both US and Canadian returns, is the right kind of person to decide whether your income really is effectively connected. This site doesn’t do that work and can’t judge your facts. It can only explain what the form says and what the Canadian calculators show.
Before you speak to anyone, gather what they’ll ask for: who pays you, what for, where the work is done, and how long the arrangement lasts. Clear answers save you time and a few bucks on the specialist’s meter.
How we checked the figures
Every rule above comes from the Internal Revenue Service’s Instructions for Form W-8ECI (the October 2021 revision) and the form itself. We didn’t confirm treaty rules, US filing deadlines for 2026 or any state-level effect, so we left them out. This website has no connection with the IRS, the CRA or any other government body.
Frequently asked questions
Do I send the W-8ECI to the IRS?
No. The IRS instructions say to give it to the person who asked for it, usually the payer.
How long is a W-8ECI valid?
From the day it's signed until the last day of the third calendar year after that, unless something on it changes.
Do I need a tax number to sign it?
Yes. The instructions say a tax identification number is required for the form to be valid.
Does a W-8ECI mean I pay no US tax?
No. It stops withholding at source, and you file a US income tax return on the income instead.
What if my address or status changes?
Tell the payer within 30 days and give them a new form.
